Scope and purposes of personal data processing

The personal data we collect are processed in accordance with the rules set out in data protection legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, "GDPR"). We keep personal data confidential and protect them against unauthorised access by third parties.

In the course of our activities we collect and process personal data:

  • in order to take steps towards concluding a contract at your request (Article 6(1)(b) GDPR);
  • in order to perform contracts concluded with clients and with suppliers of goods and services used in our activities (Article 6(1)(b) GDPR);
  • for purposes arising from the legitimate interests pursued by the Firm as data controller (Article 6(1)(f) GDPR), namely providing services to clients, pursuing claims and defending against claims, analytical purposes and marketing of the Firm's services;
  • in order to keep financial and accounting records in accordance with accounting and tax legislation (Article 6(1)(c) GDPR in conjunction with Article 74(2) of the Accounting Act and other specific provisions);
  • in order to conduct recruitment of persons interested in employment with or cooperation with the Firm (Article 6(1)(c) and Article 6(1)(a) GDPR);
  • in order to comply with legal obligations to which we are subject (Article 6(1)(c) GDPR).

Your rights

The processing of personal data and communication with you in the course of providing legal services are governed by the contracts concluded or by the general terms of legal services. As a rule, we do not send unsolicited commercial information by electronic means. If such information were to be sent, it would be conditional upon your prior consent.

In accordance with the law, you have the following rights:

  • the right to request access to your personal data, the right to rectification and the right to erasure (the right to be forgotten);
  • the right to object to the processing of personal data for direct marketing purposes, which results in our ceasing to process your data for such purposes;
  • the right to object on grounds relating to your particular situation where we process personal data on the basis of a legitimate interest; we will, however, continue to process the data to the extent necessary where there are justified grounds on our side to do so;
  • the right to data portability with respect to data processed in connection with the performance of a contract or on the basis of your consent, and the right to restriction of processing;
  • where processing is based on your consent — the right to withdraw the consent at any time; withdrawal of consent does not affect the lawfulness of processing carried out on the basis of the consent before its withdrawal.

Refusal to provide data or a request for their erasure may, in certain situations, prevent us from, for example, contacting you, providing you with information about our activities, or even performing a service. Some of the above rights may not apply to data processed in the course of providing legal assistance.

If you do not wish us to process your personal data for marketing purposes, you may object to such processing at any time.

Right to lodge a complaint

You have the right to lodge a complaint concerning the Firm's processing of personal data with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).

Retention period

As a rule, personal data are processed for the period necessary to achieve the purpose of the processing, including, as appropriate: until the legitimate interests of the data controller related to the processing of the given data have been realised, until the expiry of limitation periods related to the contract with which the processing is connected or related to the limitation of obligations arising from the law, or until an objection is raised with respect to processing for marketing purposes.

Data provided in connection with recruitment are processed until the end of the recruitment process, unless you consent to their use in future recruitment.

Personal data of our contractors' personnel are processed for the period during which, to our knowledge, those persons act as the contractor's personnel, but no longer than the contractor's own personal data, unless we act under a data processing agreement, in which case we follow the controller's instructions.

Personal data obtained in the course of professional practice are processed for a period of 10 years from the end of the year in which the proceedings in which the data were collected came to an end.

Transfers of personal data to other entities

The recipients of your personal data may include entities directly or indirectly related to the Firm, established in a Member State of the European Union, as well as external service providers (e.g. IT service providers and other entities processing data on the Firm's behalf under data processing agreements), accountants, statutory auditors, lawyers, administrative authorities, state services and courts.

Your personal data are processed at the Firm's office. Personal data are not transferred to countries outside the European Union. In connection with cooperation with its suppliers and other law firms, the Firm may entrust the processing of your personal data to the entities indicated above. In each case, those entities will be obliged to keep your personal data confidential and to process them in accordance with data protection legislation and the Firm's instructions.

No profiling

Your personal data are not subject to profiling as a form of automated processing of personal data.

Cookies

The Firm's website does not use cookies or analytical tools tracking user activity. The website does not collect personal data of its visitors.

Changes to this Privacy policy

Any changes to this Privacy policy will be published at www.azkp.com.pl and will apply prospectively only.
